Welcome to Tree-Ripe Fruit Co. These Terms of Service govern your use of our website (tree-ripe.com) and your purchase of products and services from us. By using our website or placing an order, you agree to these terms.
We’re a family-owned business that’s been delivering fresh, tree-ripened fruit for over 35 years. We want your experience with us to be great, and these terms help make that happen.
1. Acceptance of Terms
By accessing our website, creating an account, placing an order, or making a reservation, you agree to be bound by these Terms of Service and our Privacy Policy. If you don’t agree, please don’t use our website or services.
2. Eligibility
You must be at least 18 years old to place an order or create an account with Tree-Ripe Fruit Co. By using our services, you confirm that you meet this requirement.
3. Account Registration
You may create an account to make ordering easier and to track your order history. You’re responsible for keeping your login credentials secure and for all activity under your account. If you believe your account has been compromised, contact us immediately.
4. Orders and Pricing
All orders are subject to availability. Because our fruit is harvested to order, availability depends on the harvest schedule and growing conditions.
Prices are listed in US dollars and may change without notice. We do our best to ensure accuracy, but if we discover a pricing error after you place an order, we’ll contact you before processing.
We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion.
5. Payment
We accept major credit cards and other payment methods as displayed at checkout. Payment is processed when you place your order. All sales are in US dollars.
By providing payment information, you confirm that you’re authorized to use that payment method.
6. Shipping and Delivery
We ship orders using Spee-Dee Delivery Service and UPS, depending on your location. Most deliveries are in transit for 1-2 days. Orders ship Monday through Wednesday to avoid weekend delays.
We do not ship to PO boxes. Someone must be available to receive your delivery.
Due to USDA regulations, we cannot ship certain products to Arizona and California.
Weather conditions may affect shipping schedules. If extreme temperatures would compromise fruit quality, we may delay shipment to protect your order.

7. Returns and Refunds
We stand behind our fruit with a 100% satisfaction guarantee. If you receive damaged fruit, have quality concerns, or are simply not satisfied, contact us within 7 days of delivery.
You don’t need to return the fruit. We’ll work with you to make it right, whether that’s a refund to your original payment method or store credit.

8. Fruit Stop Reservations and Pickup
When you reserve fruit for pickup at one of our Fruit Stop locations, you’re reserving a specific quantity of fruit for a specific date and location.
Reservations are subject to availability. Please pick up your order during the scheduled time at your selected location. If you can’t make your pickup, contact us as soon as possible.
Unclaimed reservations may be released for sale to other customers.
9. Gift Cards
Gift cards are redeemable for purchases on our website. They do not expire and cannot be exchanged for cash except where required by law.
Lost or stolen gift cards cannot be replaced. Treat your gift card like cash.
10. Text Messaging
By providing your mobile phone number to Tree-Ripe Fruit Co., you agree to receive automated SMS and MMS messages from us at the number you provided, including:
– Replies to your customer support inquiries
– Fruit Stop reservation confirmations and pickup reminders
– Order and delivery updates relevant to your reservation or order
– Photos relevant to your inquiry (for example, of your fruit shipment)
Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of future messages. Reply HELP for help, or contact us at [email protected].

11. Intellectual Property
All content on our website, including text, images, logos, and graphics, is owned by Tree-Ripe Fruit Co. or our licensors. You may not copy, reproduce, or use our content without written permission.
The Tree-Ripe name, logo, and related marks are our trademarks. You may not use them without our permission.
12. Limitation of Liability
To the fullest extent permitted by law, Tree-Ripe Fruit Co. is not liable for any indirect, incidental, special, or consequential damages arising from your use of our website or purchase of our products.
Our total liability for any claim related to our products or services will not exceed the amount you paid for the specific order in question.

You agree to indemnify and hold harmless Tree-Ripe Fruit Co., our owners, employees, and agents from any claims, damages, or expenses arising from your violation of these terms or your use of our website or services.

These Terms of Service are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Wisconsin.
